The Kansas City District is one of 44 districts in 9 Corps of Engineers divisions which are comprised of hundreds of area, project and resident engineer offices worldwide. Our membership serves by providing comprehensive engineering, management and technical support to the Department of Defense, other federal agencies, and state and local governments. We help defend America's security - militarily, economically and environmentally.

The Kansas City District was established in 1907. Its missions include Civil Works, Military Construction and the cleanup of Hazardous, Toxic and Radiation waste. Its Civil Works boundaries take in parts of Missouri, Kansas, Iowa, Nebraska and Colorado. Its Military Construction boundaries encompass the states of Missouri and Kansas. It is the primary design district in seven states and the secondary design district in eight states for the Hazardous, Toxic, and Radiological Waste cleanup program, and facilitates the disposal of Naturally Occurring Radioactive Materials (non-fissionable materials) for the entire United States.

We have a diverse community of licensed professionals and certified technicians that are involved in direct project investigation and design activities, as well as review and oversight of activities directly performed by Architect-Engineer firms under contract to the district.

The U.S. Army has a long history of serving the development of the Nation beyond the traditional military missions. The U.S. Army Corps of Engineers Civil Works mission is varied and wide ranging, providing benefits for navigation, flood-risk management, hydropower production, fish and wildlife protection, environmental stewardship, recreation, irrigation and municipal water supply and emergency response.

To support this focus on the water and related land resources of the Nation, Corps Districts are organized according to the watersheds of our large rivers. The Kansas City District’s Civil Works mission area encompasses the Kansas and lower Missouri River basins, including parts of Colorado, Nebraska, Iowa, Kansas, and Missouri. Within this area, the district operates eighteen multipurpose lake projects and provides oversight to hundreds of miles of levees and river channels.

All USACE planning, engineering and scientific work will undergo an open, dynamic, and rigorous review process. Technical, scientific and engineering information that is relied upon to support recommendations in decision documents or form the basis of designs, specifications, and/or O&M requirements will be reviewed to ensure technical quality and practical application.

USACE Civil Works Review guidance establishes an accountable, comprehensive, life-cycle review strategy for Civil Works products by providing a seamless process for review of all Civil Works projects from initial planning through design, construction, and Operation, Maintenance, Repair, Replacement and Rehabilitation (OMRR&R). It provides the procedures for ensuring the quality and credibility of U.S. Army Corps of Engineers (USACE) decision, implementation, and operations and maintenance documents and work products.

This site describes the process for review and approval of all requests to modify, alter, or occupy any existing U.S. Army Corps of Engineers civil works projects. Civil works projects include dams, levees, channels, navigational channels, and any other flood risk management, navigation, recreation, and infrastructure and environmental stewardship projects constructed by the Corps.  It is imperative the intended functions of these projects are not jeopardized. Section 408 is intended to ensure proposed alterations to federal projects do not compromise the original purpose of the project or increase life safety risks.

General.  The sole authority to grant permission for temporary or permanent alterations is contained in Section 14 of the Rivers and Harbors Act of 1899 and codified in 33 USC 408 (Section 408).  Approval for any modifications, alterations, or occupation of civil works projects is granted through the Kansas City District’s Section 408 program.  The District Engineer has the authority to approve most relatively minor, low impact alterations or modifications to the civil works facilities; however, some requests which involve significant modifications, raisings, realignments, etc. may need to be approved at Corps Headquarters. 

A Section 408 review includes an engineering, environmental, real estate, and legal review to ensure the alteration does not impair the usefulness of the federal project and is not injurious to the public’s interest.  The Kansas City District has a streamlined process for “minor” alterations that have a low risk of impacting the federal project, which typically require 60 days to process. Alterations with more risk of impacting the project require a more thorough review.  These reviews may require 90+ days to process.  Please coordinate with the Section 408 Coordinator to determine what level of review may be required for your alteration.

The Permission Review and Approval Process.  The processing of a Section 408 permission request begins with a written request being submitted to the Kansas City District by the requester.

Engineer Circular 1165-2-216 provides the policies and procedural guidance that the Kansas City District follows in processing requests to alter or modify civil works projects that were constructed by the Corps.

Upon permission approval, the requestor is responsible for the construction oversight to ensure construction is in accordance with the plans and specifications approved by the Corps. The Corps may inspect construction.  The requester will be notified if Corps personnel will be inspecting the site.  After construction completion, notification is provided to the Corps that all permissioned construction is complete, and final documentation is to be submitted.

SILVER JACKETS TEAMS FACILITATE COLLABORATIVE SOLUTIONS TO STATE FLOOD RISK PRIORITIES

State-led Silver Jackets teams exist in all states and several territories, bringing together multiple state, federal, and sometimes tribal and local agencies to learn from one another in reducing risk from floods and sometimes other natural disasters. By applying their shared knowledge, the teams enhance preparedness, mitigation, and response and recovery efforts when such events do occur.

Although each state Silver Jackets team is unique, common agency participants include state agencies with mission areas of hazard mitigation, emergency management, floodplain management, natural resources management or conservation, etc. Federal participation typically includes the U.S. Army Corps of Engineers and the Federal Emergency Management Agency and often the National Weather Service, the U.S. Geological Survey, the Natural Resources Conservation Service, the Environmental Protection Agency, as well as others.  Resources for team activities come through the individual programs of each agency, within the constraints of available budgets.

No single agency has all the answers, but leveraging multiple programs and perspectives can provide a cohesive solution.

The Kansas and Missouri Silver Jackets team members have done several flood risk management plans (also floodplain management plans). Manhattan, Kan., Ottawa, Kan. and Independence, Mo. have been our most recent partners. The Manhattan, Kan. plans include a watershed wide plan for Wildcat Creek on their west side, which was adopted by Riley County as well as the city. KANSAS HAZARD MITIGATION TEAM

The Kansas Hazard Mitigation Team (KHMT), under joint leadership of the state's Department of Agriculture's Division of Water Resources and the Kansas Division of Emergency Management, is the long-standing entity managing participation in state-level hazard mitigation. As the KHMT has existed longer than the inception of Silver Jackets and has many of the same objectives, the state has chosen to not stand up a separate "Silver Jackets" group under a different name. The USACE Silver Jackets Coordinators participate on the KHMT. This fact sheet describes Silver Jackets in Kansas.

MISSOURI STATE RISK MANAGEMENT TEAM

The U.S. Army Corps of Engineers (USACE) funded Silver Jackets Program works with Missouri's State Risk Management Team (SRMT), which is the recognized Missouri hazard mitigation organization. Led by the State Emergency Management Agency (SEMA), the SRMT coordinates with federal and state agencies and external partners. The SEMA has an enhanced program, under their FEMA hazard mitigation plan. This fact sheet describes Silver Jackets in Missouri.

PROSPECT Course #701, CQM for Contractors Recertification Course, will no longer be offered. All recertification of the CQM-C course will be through retaking the resident PROSPECT Course #784, as was the method in the past. 


Construction Quality Management for Contractors 

USACE requires all contractors performing construction for them to comply with the “Contractor Quality Control” (CQC), requirements in their contracts. There was considerable misunderstanding as to what was required in the early development of the CQC system. In cooperation with the construction industry the Corps developed a training course entitled Construction Quality Management for Contractors. The purpose of the “Construction Quality Management for Contractors” course is to familiarize all quality management personnel with the Corps on Engineers, Construction Quality Management, (CQM) policies and procedures. The course details the requirements of the contractor personnel and the government personnel assigned to the project and the reasons for those requirements. The effectiveness of the CQM system is enhanced when all personnel are aware of their responsibilities and the reasons for them. To ensure the success of the CQC system it is a contract requirement that the contractor’s quality control representative take this training.

As the nation’s environmental engineer, the U.S. Army Corps of Engineers manages one of the largest federal environmental missions: restoring degraded ecosystems; constructing sustainable facilities; regulating waterways; managing natural resources; and, cleaning up contaminated sites from past military activities. 

Our environmental programs support the warfighter and military installations worldwide as well as USACE public recreation facilities throughout the country.  In 2002, USACE adopted its seven Environmental Operating Principles, or green ethics, which continue to guide our environmental and sustainability work today.

USACE works in partnership with other federal and state agencies, non-governmental organizations and academic institutions to find innovative solutions to challenges that affect everyone – sustainability, climate change, endangered species, environmental cleanup, ecosystem restoration and more.

USACE works to restore degraded ecosystem structure, function and dynamic processes to a more natural condition through large-scale ecosystem restoration projects, such as the Everglades, the Louisiana Coastal Area, the Missouri River, and the Great Lakes, and by employing system-wide watershed approaches to problem solving and management for smaller ecosystem restoration projects. USACE’s  regulatory program works to ensure no net loss of wetlands while issuing about 90,000 permits a year.

USACE environmental cleanup programs focus on reducing risk and protecting human health and the environment in a timely and cost-effective manner.  USACE manages, designs and executes a full range of cleanup and protection activities, such as:

  • Cleaning up sites contaminated with hazardous, toxic or radioactive waste or ordnance through the Formerly Used Defense Sites program
  • Cleaning up low-level radioactive waste from the nation’s early atomic weapons program through the Formerly Utilized Sites Remedial Action Program
  • Supporting the U.S. Environmental Protection Agency by cleaning up Superfund sites and working with its Brownfields and Urban Waters programs
  • Supporting the Army with the Base Realignment and Closure Act program
  • Ensuring that facilities comply with federal, state and local environmental laws
  • Conserving cultural and natural resources

Antiterrorism and Operational Security Training for USACE Contractors

Integration of Antiterrorism and Operations Security into the U.S. Army Corps of Engineers acquisition process is required under Army Policy. The information contained on this site will aid contractors in meeting some of the AT/OPSEC requirements contained in contracts with the Kansas City District.

For those who have a requirement to take the Antiterrorism Level 1 training to fulfill contract requirements you have two options available.

iWATCH, iREPORT, i KEEP US SAFE (iWATCH ARMY) is a community program to help your neighborhood stay safe from terrorist activities.

You and your fellow Army community members can report behaviors and activities that make you feel uncomfortable and do not look right (suspicious behaviors).

iWATCH ARMY is a program and partnership between your community and your local law enforcement.

iWATCH ARMY asks you to report behavior and activities that are unusual or seem out of the ordinary.

Trust Your Instincts

We rely on our senses every day of our lives. If a behavior or activity makes you feel uncomfortable, report it!

Here are some examples of suspicious activities reported by concerned individuals that saved lives:

A video store clerk saw anti-American material on a DVD he was asked to copy. Police captured and arrested individuals planning an attack against a military installation.

If it doesn’t LOOK right, report it!

A grandmother smelled bad odors from the neighboring apartment and noticed that the empty apartment was frequented by various people. Police discovered a poison gas factory.

If it doesn’t SMELL right, report it!

Residents were concerned with a person’s threats of violence. Police captured and arrested a group planning a subway attack.

If it doesn’t SOUND right, report it!


Why Report These Behaviors and Activities?
It is your awareness reported to local law enforcement that can help predict and prevent attacks before they happen.

Since 9-11, we can and must work together to prevent future attacks.

It is always better to report suspicious behaviors than to refrain from doing so.

The iWATCH ARMY program is about behaviors and activities, not individuals.

What Activities Do I Report?

  • Here are examples of behaviors and activities to report:
  • People drawing or measuring important buildings.
  • Strangers asking questions about security forces or security procedures.
  • A briefcase, suitcase, backpack or package left behind.
  • Cars or trucks left in No Parking zones in front of important buildings.
  • Intruders found in secure areas.
  • A person wearing clothes that are too big and bulky and/or too hot for the weather.
  • Chemical smells or fumes that worry you.
  • Questions about sensitive information such as building blueprints, security plans or VIP travel schedules without a right or need to know.
  • Purchasing supplies or equipment that can be used to make bombs or weapons or purchasing uniforms without having the proper credentials.

Example Situations
“There’s a chemical smell coming from my neighbor’s apartment.”

“I saw someone taking measure-ments. I don’t want to get them in trouble. What should I do?” (This activity may be repeated at other locations and you may be reporting one piece of the puzzle.)

“Maybe someone just forgot their briefcase on the bus.” (Do not check it yourself. It may be a test.)

“I saw someone watching our offices, and the next day my co-worker was asked a lot of questions about our building by someone else.” (Do not check it yourself. It may be a test.)

There are three ways to make a report:

  • Call [insert phone number]. An expert will answer the call and advise you.
  • Call your local military police station [phone number] and make your report to the desk officer.
  • In an emergency call [local hotline]
  • All information will be kept confidential. Information submitted will be carefully assessed and, if warranted, investigated by trained investigators. All information gathered and all investigative activity will be subject to strict policies designed to protect the privacy and civil liberties of American citizens while protecting our Nation from terrorism

TECHNICAL SUPPORT:

Our Real Estate Division is one of three Technical Divisions within the Kansas City District, along with Engineering & Construction Division, and Operations Division.

A Technical Division can be described as being a money earner for the District, i.e. funding is provided directly to us by our customer. Other divisions and offices within the District are administrative or overhead in nature, which are funded by the Technical Divisions through district budgetary processes. Overhead and burden are computed by Resource Management and applied to Technical Divisions as a cost of doing business.

AUTHORITY:

Real Estate Division has the authority to administer real estate actions in accordance with ER 405-1-12, and by authority of Chief of Engineers, US Army Corps of Engineers, HQUSACE. This authority is delegated to the Kansas City District Commander and is further delegated to the Chief of the Real Estate Division.

All mailed applications for agricultural leasing are due no later than the day before the bid by close of business. Bidders should note that there may be delivery limitations for PO Boxes and that the bidder is responsible for accounting for those limitations for their chosen delivery method.  The bid openings will be on Thursday, April 17, 2025, at the Kansas City District's Real Estate Office.  In person attendance will not be allowed. Personal delivery of bids will be allowed per the instructions contained within the announcement.  Instructions for observing the bid openings via phone are also contained within the announcement.

Kansas City District Contracting Opportunities Forecast

Missions include Civil Works, Military Construction, Regulatory, and the cleanup of Hazardous, Toxic and Radiation waste. Civil Works boundaries include parts of Missouri, Kansas, Iowa, Nebraska, and Colorado; and manages 500 miles of the Missouri River, 18 lakes, and 2 hydropower facilities. Military Construction serves 7 military installations with construction services in Missouri and Kansas, as well as the U.S. Army Reserve Design Program in 10 states stretching northward from Missouri. It’s the primary design district in 7 states and the secondary design district in 8 states for the Hazardous, Toxic, and Radiological Waste cleanup program, and it is responsible for Naturally Occurring Radioactive Materials Disposal (nonfissionable materials) for the entire U.S. The District provides emergency response and recovery to Kansas and Missouri under Public Law and the Nation under the National Response Framework.

How to Register:

You must register your business in the System for Award Management (SAM) at https://www.sam.gov/SAM/ before submitting an offer or quote. Registration is free. 

  1. If you need help during SAM registration fisit the, Federal Service Desk at https://fsd.gov/fsd-gov/home.do for contact information via live chat, web form, or phone. 
  2. If you would like to be included in the Disaster Recovery Registry, you must indicate this during the SAM registration process; see information at https://www.acquisition.gov/disaster-response-registry.
  3. A current Commercial and Government Entity (CAGE) code is required to do business with the Federal Government. During the Same registration proces, a cage code will be assigned to your business.

Acquisition Regulations, Instruction, and Desk Guide

USACE contract awards and administration are goverened by three regulations and an acquisition and instruction with companion guide. You will need to become familiar with each:

Contract Opportunities

  1. Search for USACE contract opportunities at https://sam.gov/. Contract opportunites may be searched by keyword, solicitation number, or District/Center name. Each contract opportunity is classified by a Product Service Code (PSC) or Federal Supply Code (FSC), and a North American Industry Classifcation System (NAICS) code. Thus, it is important to know which PSC, FSC, or NAICS applised to your industry. To learn about a PSC or FSC, view the Product and Service Code Manual at https://www.acquisition.gov/psc_manual. To learn about NAICS codes, visit https://www.census.gov/naics/
  2. If you are a Small Business, to find subcontracting opportunities on USACE contracts, search the Small Business Administration (SBA) Subcontracting Network at https://catalog.data.gov/dataset/subcontracting-network-subnet-system.
  3. For all USACE contract awards, conduct a Contract Data search at https://sam.gov/. A search of the data is a great way to seek subcontract opportunities, as well as monitor expiring contracts for future contract opportunities.

The Freedom of Information Act (FOIA) 5 U.S.C. § 552, is a Federal law that establishes the public's right to request existing records from Federal Government agencies. FOIA, along with Army Regulation 25-55, govern how requests will be processed within the Army. Additional information and resource links can be found at the U.S. Army Corps of Engineers main FOIA website, located here.

A request for information submitted under the FOIA must contain the following information:

  1. Name.
  2. Business name (if applicable).
  3. Address.
  4. Telephone number.
  5. Complete, in-depth description of document including a date range. 
  6. That you are seeking copies of the documents.
  7. That you are willing to pay all fees associated with the request.
  8. If you are requesting a fee waiver, you must state your basis for the waiver.

Under the FOIA, the agency has twenty business days from the receipt of your request in the Office of Counsel. Please note that the FOIA does not require Federal Agencies to answer questions, render opinions, or provide subjective evaluations. Requesters must only ask for agency records. The agency is not required to create documents in response to a FOIA request.

The purpose of this information is to provide guidance on how to make a Freedom of Information Act (FOIA) request for Department of the Army records. It will provide you with a brief description of your rights and the manner in which Army will respond to your requests.

Filing a claim against the Army Corps of Engineers under the Federal Tort Claims Act

For a claim of personal injury or property damage, that a person alleges has been caused by the negligent acts of an employee of the United States Government, federal law requires that the claimant file a written claim with the appropriate federal agency, in this case the U.S. Army Engineer District, Kansas City, Missouri. The applicable law in this instance is the Federal Tort Claims Act, 28 United States Code § 2671 et seq. Standard Form 95 must be used to submit a claim under the Tort Claims Act. A copy may be obtained and printed by clicking SF 95.

A claim against the United States, in particular against the U.S. Army Corps of Engineers, must be presented, in writing, within two years from the date that the cause of action occurred. The written claim must indicate the date and location at which the alleged negligent act/damage occurred. The written claim must include a specified "sum certain" amount of monetary damages that you seek from the government. You should state in your claim the damage that has occurred, and should state how you contend that the damage occurred (i.e., what acts of a government employee occurred that caused the damage you seek compensation for). If the claim is for personal injury or property damage, you should submit information that would substantiate your claim. Medical Records, estimates of repair, etc., should be submitted, along with any other documentation you think would support your claim.

Once the claim is received, this agency will have six months from the date of receipt in order to investigate and adjudicate your claim. It is possible that, if warranted, an administrative settlement could be negotiated with you. It is also possible that the claim could be denied. During the six months from the date of receipt of your written claim by the agency, you cannot file a lawsuit against the United States of America. A lawsuit against the United States cannot be filed until the following occurs:

1) Upon receipt of a final, written decision from the Agency, the claimant will have six months from the date of the decision in order to file suit;

2) Upon the expiration of six months from the date of receipt by the Agency of the claim, if no written final decision has been issued by the Agency, the claimant may, at his or her option, treat the inaction of the agency as a final denial, and proceed to file suit.

Exclusive jurisdiction against the United States for suits filed under the Federal Tort Claims Act lies with the appropriate United States District Court. Any lawsuit filed under the Federal Tort Claims Act must name the "United States of America," and not the particular agency, as the defendant.

Requesting Witnesses or Documents for Private Litigation (Touhy Request)

Under Title 32 of the Code of Federal Regulations, sections 97.6(c), 516.40 and 516.41 (32 C.F.R. §§ 97.6(c), 516.40, and 516.41), the Army must authorize the appearance of its personnel or the production of official documents in private litigation. 

You must request in writing the employees appearance in accordance with Department of Defense directives, 32 C.F.R. § 97.6(c), and Army regulations, 32 C.F.R. §§ 516.40 - 516.56.  The request must include the nature of the proceeding and the nature and relevance of the official information sought.  See id. at § 516.41.  The written request must be received no later than 14 days from the date of any intended testimony.  We cannot act upon your request until we receive the required information.  Seee.g., United States ex rel. Touhy v. Ragen, 340 U.S. 462 (1951).

Please furnish this office with a written statement setting forth a detailed summary of:

1.  The name of the employee you seek to testify;
2.  The testimony you seek to elicit from the employee;
3.  The nature of the proceedings and the relevance and importance of the testimony to the proceedings; and
4.  The extent to which the testimony is available from other sources.

Please provide this written summary as early as possible.  By virtue of Touhy v. Ragen, 340 U.S. 462 (1951), the Supreme Court has recognized the authority of agency heads to restrict testimony of their subordinates.

In addition to the above requirements, each employee’s supervisor must approve their absence from duty so that their absence does not interfere with the mission.  See 32 C.F.R. § 516.50.  In any event, if they are authorized to appear, you must pay all travel expenses, as this is purely private litigation and the witness' appearance is at no expense to the United States.  See id. at § 516.55(c).

Finally, should any of the employees appear as a witness, they may give factual testimony only.  They may not testify as an expert witness or provide an opinion.  This limitation is based on Department of Defense and Army policy that generally prohibits Government employees from appearing as expert witnesses in private litigation.  See id. at § 97.6(e), § 516.49.
