Reissuance of Nationwide Permits

REISSUANCE OF NATIONWIDE PERMITS: On January 8, 2026, the U.S. Army Corps of Engineers (Corps) published a final action in the Federal Register (91 FR 768) announcing the reissuance of 56 existing nationwide permits (NWPs) and one new NWP, as well as the reissuance of NWP general conditions and definitions with some modifications. These 57 NWPs will go into effect on March 15, 2026, and will expire on March 15, 2031. One NWP was not reissued. The Corps has also issued final decision documents for the new and reissued NWPs. These final decision documents are available at www.regulations.gov at docket number COE-2025-0002. Furthermore, the national NWP decision documents will be supplemented by Division Engineers to address decisions concerning the addition of regional conditions to the NWPs. EXPIRATION OF 2021 NWPs: The 56 existing NWPs published in the January 8, 2026 final action replace the 2021 versions of these NWPs. The 2021 versions of these NWPs expire on March 14, 2026.

The project/review area is located on the Fort Leavenworth Military Installation (FTLV), specifically within the Sherman Army Airfield (Airfield) at the northern end of the installation, along the western bank of the Missouri River, in Section 36, Township 53 north, Range 36 west, Leavenworth County, Kansas. PROPOSED WORK: The applicant requests authorization for completing repairs of the damaged levee and associated infrastructure.

This Special Public Notice announces the decision of the U.S. Army Corps of Engineers, Kansas City, St. Louis, Rock Island, Memphis, and Little Rock Districts to accept and expend funds from the Missouri Department of Transportation and Missouri Highway Transportation Commission to expedite processing of their Department of the Army permit applications. This decision expands the current funding agreement that expires December 31, 2025, used for projects only within the Districts of Kansas City and St. Louis, and follows previous public notices issued by the Kansas City District in 2024 regarding the funding arrangement.

The U.S. Army Garrison at Fort Leavenworth and with assistance from the U.S. Army Corps of Engineers, Kansas City District has prepared a revised Draft Environmental Assessment, associated Finding of No Significant Impact, and a Finding of No Practical Alternative in accordance with the National Environmental Policy Act for Fort Leavenworth Levee Repairs. The revised Draft Environmental Assessment includes updated information regarding the Action and its potential effects to the human and natural environment. PROJECT LOCATION: The Action is located on the Fort Leavenworth Military Installation in Leavenworth County, Kansas. Sherman Army Airfield occurs at the northern end of the installation, along the eastern bank of the Missouri River.

On June 18, 2025, the U.S. Army Corps of Engineers published in the Federal Register its proposal to reissue 56 existing nationwide permits (NWPs) and issue one new NWP. One NWP is not proposed for reissuance. Missouri is covered by five Corps Districts (Kansas City, St. Louis, Little Rock, Memphis and Rock Island). The KCD, as the lead district for Missouri, and in coordination with the other four Districts, is seeking comments on the proposed regional conditions and seeking comments on the need for additional regional conditions to help ensure that the adverse environmental effects of activities authorized by the proposed NWPs are no more than minimal, individually and cumulatively.

The methods are rapid assessment tools to help distinguish between ephemeral, intermittent, and perennial streamflow at the reach scale for the Northeast and Southeast SDAM Regions.

PROPOSED WORK: The Dredgers have requested renewal of their Department of the Army (DA) authorizations to dredge sand and gravel for commercial purposes from the Missouri River in the states of Kansas and Missouri.

Emergency Processing Procedures for Activities Subject to Executive Order 14156 (National Energy Emergency)

TO WHOM IT MAY CONCERN: The purpose of this notice is to advise the public that the U.S. Army Corps of Engineers, Northwestern Division has approved the use of special emergency processing procedures by the Kansas City District in accordance with 33 CFR § 325.2(e)(4) for activities covered by the National Energy Emergency declared in Executive Order (EO) 14156. That EO was issued on January 20, 2025, under the President’s legal authorities, including the National Emergencies Act (50 U.S.C. §§ 1601 et seq.) and 3 USC § 301. These special emergency processing procedures have been approved for activities associated with the identification, siting, production, transportation, refining, and generation of domestic energy sources, including energy infrastructure, that require Department of the Army authorization under Section 10 of the Rivers and Harbors Act of 1899, Section 404 of the Clean Water Act, and/or Section 103 of the Marine Research, Protection, and Sanctuaries Act of 1972, as amended, where there would be an unacceptable hazard to life, a significant loss of property, or an immediate, unforeseen, and significant economic hardship if the action requiring a permit is not undertaken within a time period less than the normal time needed to process the application under standard procedures.
