  • SPECIAL PUBLIC NOTICE - CLEAN WATER ACT PROPOSED RULE FOR A REVISED DEFINITION OF THE “WATERS OF THE U.S.”

    On February 14, 2019, the U.S. Environmental Protection Agency (EPA) and the Department of the Army (Army) published for public comment a proposed rule revising the definition of “waters of the United States,” which would establish the scope of federal regulatory authority under the Clean Water Act (CWA). The proposed rule is intended to satisfy the requirements of Executive Order (EO) 13778 that directed the EPA and the Army to review and rescind or replace the 2015 Clean Water Rule (80 FR 37053) and consider interpreting the scope of “waters of the United States” consistent with the Justice Scalia opinion (plurality standard) from Rapanos v. United States (2006). The EO instructed that any new proposed rule shall ensure that the Nation’s navigable waters are kept free from pollution, while at the same time promoting economic growth, minimizing regulatory uncertainty, and showing due regard for the roles of the Congress and the States under the Constitution.

    APPLICANT: Hunt Midwest Real Estate Development, Inc. PROJECT LOCATION: The project occurs within Section 35, Township 51 North, Range 32 West and Section 2, Township 50 North, Range 32 West, in Kansas City, Clay County, Missouri. PROPOSED ACTIVITY: The project consists of the construction of an industrial development on an approximate 300-acre site, known as the Hunt Midwest Commerce Center Plat 6.

PROJECT LOCATION: The project site is located within the floodplain of the Kansas River, north and outside the city limits of DeSoto, Kansas in Section 22, Township 12 south, Range 22 east, Leavenworth County, Kansas. ACTIVITY: Development of the Lenape Sand Quarry. The proposed work would involve operations involving clearing, grading, excavation and the placement of fill materials into wetlands to prepare and operate a sand dredging operation within a 223-acre site adjacent to the Kansas River.

    APPLICANT: MD Management, Inc. PROJECT LOCATION: In three unnamed tributaries of Second Creek and adjacent wetlands. The proposed work activities are located in Sections 3 and 4, Township 51 north, Range 33 west, in Platte County, Missouri. ACTIVITY: The applicant proposes to fill a total of 784 linear feet of stream and a total of 1.985 acres of wetlands for the construction of new roadways including the extensions of North Line Creek Parkway, Tiffany Springs Road, and North Platte Purchase Drive Roadway in Kansas City, Missouri, all as part of a Platte County TIF project.

    APPLICANT: BK Properties for Renner 113 LLE LLC & LL East LLC PROJECT LOCATION: In fourteen wetlands, and three tributaries of Mill Creek, northeast of W 119th Street and Renner Boulevard, in Section 17, Township 13 south, Range 24 east, in Lenexa, Johnson County, Kansas. ACTIVITY: The applicant proposes to place fill material within waters of the United States for the construction of four industrial warehouse facilities on approximately 80-acres of undeveloped land.  The industrial warehouse facility development also includes the construction of roads, vehicle and freight parking, utilities, stormwater detention, and green space.  The purpose of the project, as stated by the applicant, is to meet the demand for industrial warehouses along the Renner Boulevard corridor in Lenexa.
